The Trans-Pacific Partnership Agreement (TPPA) is a ‘free market’ economic circuit deal between twelve Asian and Pacific-rim countries, that favours wealthy investors’ commercial rights over the needs, human rights and aspirations of ordinary people. The TPPA is being negotiated in secret between corporate lobbyists and government representatives from: Australia, Brunei, Chile, Canada, Japan, Malaysia, Mexico, New Zealand, Peru, Singapore, the United States, and Vietnam.[i]

Around the world, governments are giving away a level of sovereign power to a global investment class in accordance with the strictures of a strategy known as new constitutionalism. This strategy seeks to expand markets by locking in the changes within a supranational jurisdiction, thereby restricting the democratic participation of nationally-based publics and indigenous peoples.

‘New constitutionalism’ is embedded into the Trans-Pacific Partnership Agreement (TPPA). Armies of professionals, sponsored politicians and elite technocrats are working on what is essentially a global neo-colonial project (AKA globalization), which is an economic war framework directed by the super-rich.[ii]

From the leaked chapters, we know that the Trans-Pacific Partnership Agreement (TPPA) will:

  • Give transnational corporations the capacity to directly sue governments in secret tribunals;
  • Allow foreign investment and financial speculation to be even less restricted;
  • Undermine protections for labour, while strengthening copyright claims over workforce creativity;
  • Roll-back environmental protections written into legislation, regulations, and bylaws;
  • Dismantle obligations to treaties that protect general human rights, indigenous rights, and nature;
  • Favour anti-competitive cartels of transnational corporations that undermine small-scale producers;
  • Allow big pharmaceutical corporations to charge more for medicines;
  • Undermine popular dissent by privileging the fiction of investors’ ‘commercial sovereignty’.

Global Wave of Civil Disobedience Coming to a Street Near You!

A global non-violent grassroots civil disobedience initiative called a “Worldwide Wave of Action” is set to start this April 4 to coincide with the anniversary of the assassination of civil rights leader, Dr. Martin Luther King Jr.

The idea of the Worldwide Wave of Action, which is organized by activist group Anonymous, is to encourage diverse groups around the world to creatively engage in public acts of civil disobedience, events, private acts of protest, and community-building initiatives, from Friday April 4.

The Worldwide Wave of Action has been called to confront corruption, propaganda and the outsized power of transnational corporations.

The three-month action, described as a “global uprising” by key Occupy Movement organizer David DeGraw, will start at 6:05pm in Chicago, Illinois, which is the approximate time that the civil rights movement leader was shot.

For several years, New Zealand’s trade minister Tim Groser has been a leading driver of negotiations for a new ‘free trade’ pact called the Trans-Pacific Partnership. As the name suggests, these negotiations are between 11 countries that either border the Pacific Ocean, or are surrounded by it. Citizens groups opposed to this ‘free trade’ agreement have formed in these countries. In New Zealand, groups called “TPP Watch” and “It’s Our Future” argue that the Trans-Pacific Partnership Agreement (TPPA) will lock in investor rights that favour the wealthy, while curtailing the partnering governments from performing regulatory functions that might interfere will corporate profits. This agreement impacts on financial regulation, healthcare products, environmental laws, protections for workers, labelling of genetically modified foods and the termination of the Treaty of Waitangi (te Titiriti o Waitangi).[i]

In mid-2012, a chapter on investment from the privately-negotiated Trans-Pacific Partnership Agreement (TPPA) was leaked. When confronted by the news media, John Key and his trade minister, Tim Groser, promptly downplayed the significance of this agreement.[ii] The Trans-Pacific Partnership Agreement, had been marketed as a ‘free trade’ agreement between a growing number of countries – America, Australia, Brunei, Canada, Chile, Japan, Malaysia, Mexico, New Zealand, Peru, Singapore and Vietnam.

In response to this leak, the associate dean of research at Auckland University’s Law School, Jane Kelsey, argued that the Trans-Pacific Partnership Agreement is actually a charter of investment rights between the eleven nation state jurisdictions and that its provisions would “lock in the current investment regime”[iii] This would mean for example, that if any government of any nation that is party to the agreement attempted to reverse privatizations, the ‘offending’ government can be sued in what Kelsey argues are “secretive offshore investment tribunals.”

Thus, under the TPPA, transnational corporations would gain the capacity to directly sue governments under Investor-State Dispute Settlement provisions in parallel judicial systems such as the International Centre for the Settlement of Investment Disputes.[iv] In other words, governments are giving away a level of sovereign power to a global investment class in accordance with the strictures of new constitutionalism.

New constitutionalism is a strategy that seeks to expand markets by locking in the changes within a supranational jurisdiction, thereby restricting the democratic participation of nationally-based publics.[v] ‘New constitutionalism’ enshrines the fluidity of capital, and positions the investor as a sovereign legal person, and is a crucial strategy to the transnational capitalist’s class’ global neo-colonial project. Since mid 2012, the negotiations for the Trans-Pacific Partnership Agreement (TPPA) have continued to be conducted in secret, dispite public opposition in New Zealand and around the world. The Trans-Pacific Partnership Agreement (TPPA) is the latest economic framework within a ‘global neocolonial project’. The details of the negotiations are conducted in secret because key insiders know that they transferring economic and political power to international and supranational rule-setting institutions. Such a regime strategy is called ‘new constitutionalism’, which is designed to restrict democratic accountability to nation state citizenries.

Absent full disclosure of the TPPA texts, cartel and conspiracy law theories predict that entrapment underpins the secretive negotiations. Cartel theory models collusion for economic gain. Conspiracy law models for political gain. In the realm of political economy, both collusion and conspiracy involve secret agreements to gain at the detriment of society, wherein the real intent is hidden or denied.

Thus, even publicly notified schemes such as the Trans-Pacific Partnership can still involve conspiracy and collusion by using ‘free market’ era ‘speed politics’ to overwhelm communities (who get little help from the corporate-state funded mainstream media).

Because capitalism is a private political system designed to limit as many people as possible from having access to land, dominant capitalist coalitions use subterfuge to hide the economic repression inherent to the capitalist state system. It is crucial to the transnational capitalist class that communities are prevented from developing economic autonomy, lest they gain the means to real political freedom (as opposed to the so-called freedom to work as a debt slave that has been won by fighting wars for the wealthy).
